TERMS OF SALE Any alcoholic beverage that is sold to you from Premium Wine and Spirits, LLC (D.B.A., Pasanella and Son, Vintners and hereinafter referred to as ⌠PWS■) is sold in New York and the title passes to the buyer in New York. The buyer is solely responsible for the shipment of alcoholic beverages. We make no representation concerning your legal rights to ship or import alcoholic beverages into any state outside of New York, and we cannot ship alcoholic beverages to certain states. By placing an order, you authorize us to act on your behalf to engage a common carrier to deliver your order to you. Alcoholic beverages may be sold and delivered to persons who are at least 21 years old. By placing your order with PWS you certify under penalty of perjury that you and the recipient are at least 21 years old. When the alcoholic beverage is delivered, the recipient will be required to show identification proving that he or she is at least 21 years old. PWS wants to make note to our customers that pregnant women and women who may become pregnant should abstain from alcohol to eliminate the chance of giving birth to a baby with the harmful effects of fetal alcohol spectrum disorders. PWS will not be held responsible for goods held for over 90 days. PWS makes no warrantee, expressed or implied, about the alcoholic beverage being sold except that to our knowledge, the alcoholic beverage is what the label describes it to be. Specifically, wine by nature is a living thing and is subject to natural changes in the bottle over time. PWS makes no guarantee of the quality or drinkability of any wine sold. Due to the exclusive nature of our products, Pasanella & Son reserves the right to substitute items of equal or higher value in gifts baskets, boxes and sets. Pasanella & Son will delivery all local NYC orders via messenger with a $15 delivery charge per address. For NY and out of state shipments, Pasanella & Son uses UPS as its courier service. UPS shipping charges depend on weight and destination and will be calculated per shipment. Unfortunately, Pasanella & Son is unable to ship to PO boxes, APO, FPO addresses or international addresses. ALL DELIVERIES REQUIRE AN ADULT SIGNATURE. Extreme weather conditions can damage wines. We recommend second-day shipping outside Manhattan for all urgent orders that are placed during particularly cold months and will not be responsible for damage to orders placed for regular ground shipping at these times. In extremely hot weather we will not send shipments via ground or second-day air service to those areas experiencing very hot weather. Our clientele is reminded that various states impose limitations on the quantity of alcoholic beverages brought into their jurisdiction by a purchaser from another state without the proper license. Shipments to those states are restricted to non-alcoholic items such as glassware, antique corkscrews, and any other accessories that we carry.
